  1. Jane is a great worker and has a good history with her employer (Sarah). At office parties, however, her husband (who does not work for the employer) is regularly loud and obnoxious, visibly upsetting many other employees. After the most recent party, Sarah calls Jane her into her office and fires her because Sarah does not like Jane's husband. Jane is an at-will employee and does not have a contract with the employer. Does Jane have a good case for unjust dismissal?
  2. Judy Boyle was a lab helper for Vista Eyewear Company. As a lab assistant, she was responsible for hand-edging, hardening, and testing the eyeglasses manufactured and sold by the company. One of the eyeglass tests required by the FDA was a chem/drop-ball test that tested the glasses for resistance to breaking or shattering, or both. Mrs. Boyle claims that this test was not conducted by Vista, even though she and her coworkers were required to fill out a form for each pair of glasses confirming that the test had been conducted. Mrs. Boyle talked to David Baker, the president and co-owner of Vista, and he reassured her that he had ample insurance to cover any potential liabilities. Boyle reported the lack of testing to the FDA, but Baker had another employee, Bob Bond, testify to the FDA that this charge was not true. Boyle was discharged a few weeks later for an unrelated reason. Does she have a claim for unjust dismissal?

  4. Spivey was a retired carpenter who occasionally drove automobiles from one location to another for automobile dealers. Generally, the dealership would contact Spivey to drive various automobiles to locations designated by the dealerships. Spivey was hired by an Acura dealer to drive a car from Raleigh to Fayetteville. Because several cars needed to get to Fayetteville at the same time, several of Spivey's friends were also hired. Spivey was unaware of the route to Fayetteville and planned to follow one of the dealer's employees, who was driving a van at the head of the motorcade. The van was intended to bring the drivers home from Fayetteville. As Spivey was driving the car out of the lot, he ran into Brewer, a pedestrian. Brewer filed suit against Acura, which defended itself claiming that Spivey was not its employee. Are they correct? Include an analysis of the factors that would come into play when making a determination.
  5. An employee receives a letter of reprimand that goes in her personnel file but is not demoted and does not suffer any other action. Does the letter constitute an adverse employment action?
