1) Harriet lost her job. She was unable to find work for several months and fell behind in the payment of her debts. A debt collector telephoned her at 11:45 p.m., used profanity, and threatened to take care of her if she didn't pay the amount owed. Were Harriet's rights violated? Explain.

2) Sara likes to shop online at Amazon. One day she purchased a lamp from Amazon. While it was being shipped to her via the United States Postal Service, the mail truck on which her package with the lamp was traveling got into an accident and all of the contents in the truck were destroyed. Is Amazon required to replace the lamp? Make sure to full explain why or why not.

3) Mike and Jane contract to purchase and sell $1,000,000 worth of computer chips to be manufactured in Japan and shipped to San Francisco. The contract is silent about the method of delivery. Mike asserts that delivery is by ship, which is customary in the computer chip industry, but Jane insists that delivery is by air, which is what a previous contract between Mike and Jane provided. Explain how a court will resolve this dispute.

6) Gaskin, Ohio is the home of Ransom College. Each August the population of the small village triples as the students return. When this happens, the traffic in the middle of town becomes congested and the exhaust from the cars chokes the entire downtown area. This year the Village Council of Gaskin passed an ordinance that required the installation of emission control devices in all vehicles as a new licensing requirement. A dozen students brought suit in the U.S. District Court in Columbus asking the court to declare the new ordinance invalid and to prevent its enforcement. The students contended that the Clean Air Act, which did not make such demands, preempted the Village ordinance. Under what, circumstances will a federal law like the Clean Air Act preempt state and local law? Explain. Who will prevail in this case, the village or the students? Explain.
