1. Lakam Leyrow, a 16 year old High School drop out due to the COVID-19 pandemic was given a job on behalf of Real Good Chicken Farm, a company owned and operated by Dubious Ramnarine, to assist in the sale and delivery of chicken to Sweethand Fried Chicken Limited. Chicken was to be delivered every Friday by 1.00 pm. The driver of the containerised van was Benjamin Black. Black and Leyrow collected chicken from Real Good Chicken Farm at 10.00 am on Friday October 22 and left Siparia where Real Good Chicken Farm is located to make their way to Sweethand Fried Chicken Limited at its Arima headquarters. It was a blistering day, and the heat was stifling as Hurricane Ronaldo made its way through parts of the Caribbean. While driving along the Mosquito Creek near San Fernando, the vehicle experienced mechanical problems and Black was forced to stop at the side of the road. Frustrated by his failed attempts to start the vehicle, Black took out a joint of cannabis and commenced smoking. He indicated to Leyrow that he was attempting to cool his brains. Shortly thereafter, Black started speaking in an incomprehensible manner and it became clear that he was "high". Leyrow who had some mechanic skills continued to try to fix the vehicle and was successful in getting it started. Seeing the condition of Black, Leyrow started the vehicle in an attempt to continue the delivery. However, after proceeding for about a 1 kilometre the vehicle stalled again, The chicken was stored in a chilled compartment of the vehicle. Leyrow started to worry about the spoilage of the chicken as the chiller was totally non-functional when the engine was switched off, and with the heat the situation could result in the dumping of the chicken. The contract between Real Good Chicken Farm and Sweethand Fried Chicken Limited required the delivery of chicken already killed, plucked, gutted and cut be completed within three hours to prevent spoilage in a vehicle with a chilled compartment. It was now just an hour before 1,00 pm and hardly likely that they would arrive in time at Sweethand Fried Chicken Limited Leyrow tried calling Real Good Chicken Farm for instructions but realized that he had no money on his cell phone. He tried flagging down vehicles to beg for a phone call but was unsuccessful. Finally, Peter Smartman driving a three ton truck, stopped and asked him what was the problem. Leyrow explained his predicament and indicated that the chicken would soon be spoilt, and he wanted to make a call. Smartman a former student of Professor Rajendra Ramlogan who is allergic to cell phone, said that he did not have a phone but would buy the chicken at $2,50 a pound dead weight Leyrow knew that the chicken was being sold at $6.50 per pound but to prevent the total loss of the chicken, decided to sell it to Smartman who agreed to pay 50% of the cost immediately and then sign a promissory note to pay the balance within 24 hours. Smartman then took delivery of the chicken. Leyrow five hours later got through to a tow truck and was making preparation for the vehicle to be towed to Siparia, Leyrow was sitting in the driver seat with the key in the ignition when a police vehicle stopped alongside him. A police officer came out and inquired as to his drivers permit which he could not produce as he was not the holder of one. He was charged under the Motor Vehicle Act which prescribed that "No person shall intentionally drive or be in control of a motor vehicle without a valid drivers permitdrive or be in control of a motor vehicle without a valid drivers permit". The tow truck took the vehicle to Siparia, where Leyrow was met by Dubious who inquired as to what happened. Dubious indicated that he was not happy with the price paid for the chicken and he wanted more money. Dubious called Smartman the next day and stated that he wanted 25% more than was agreed upon for the chicken or he would sue for recovery of it. Smartman informed him that not only was he not paying extra but he was not even paying the balance owed on his initial agreement. Leyrow is worried about the ticket he received. Please advise Smartman, Dubious and Leyrow
