Case (3-4122 Vader and Cersei v France Vador is a national of the (ctional) Republic of Tatooine. He holds a Master of Science degree in the eld of information technology awarded by Tatooine's University of Technology- This University has been the subject to EU 'restrictive measures" because of its links with the Tatooinean government in particular in the military eld. During a University trip to Ireland in March 2021, Vador met Cersei, an Irish national and then a student enrolled in a postgraduate computer science, at the Temple Bar University Dublin. After a few glasses of whiskey, they fell in love and decided to get married, which they did a few months later in Tatooine. In January 2022, Vador received a grant 'om ParisSorbonne University in order to pursue doctoral studies there. The subject of his doctoral research project is 'mobile malware'.2 Cersei, Vador's Irish spouse and therefore an EU citizen as Ireland is a Member State of the EU, was also successful in her doctoral grant application and she moved to Paris in February 2022 to begin her doctoral research on the same subject matter, that is, mobile malware- Unlike Cersei, Vador had to apply for an entry visa prior to entering France. His visa application submitted at the French embassy located in Tatooine was however turned down on the ground that any period of study in France would enable him to acquire knowledge which could be subsequently misused in Tatooine. Following this decision, the French government also notied Cersei that she had to leave France or face removal on the ground that her marital relationship with her Tatooinean spouse made her a threat to public security- Unhappy with these two decisions, Vador and Cersei subsequently brought an action before the relevant French court which, in turn, decided to stay the proceedings and ask the Court of Justice the following two questions: 1! Does EU Law, and in particular Directive 2004B 8, give national authorities an unqualied power to refuse the granting of an entry visa to a non-EU family member of an EU citizen should the non-EU family member be deemed to represent a threat, even if potential, to public security in circumstances such as those of the present case? 2! Does Directive 2004138 allow or preclude national authorities from taking an expulsion decision on ground of public security against an EU citizen due to a marital relationship with a non-EU national who is deemed to constitute a threat, even if potential, to public security in circumstances such as those of the present case? Having received the reference in March 2022, the Registrar of the Court of Justice notified Vador and Cersei as well as the French government and invited them to attend an oral hearing in Spring 2018. As counsels for either the applicants {Vador and Cersei) or the respondent (French government), you are responsible for preparing a presentation to be delivered during the oral hearing. The Registrar of the Court has allocated you a maximum of 10 minutes to each party to present their arguments in relation to the questions submitted by the national referring court
