Toni is a 17year old with a privileged upbringing. He inherited millions held in Trust from the death of his parents. He attended a private home auction with the intention of buying a new home to settle in as he refused to be reminded about the death of his parents from his old home. City Brokers were hosting a private home auction with finger foods and cocktail drinks.

Toni was impressed and excited with the environment of the private auction and decided to try the champagne. After 2 glasses of champagne, he was feeling extremely happy and successfully bid for the home for $1million. The auction was held in one of the private homes but Toni had placed his bid thinking it was the same house where the auction was hosted. His bid was for a house closer to the city slums. Unfortunately, at the time of the bid, the house was being torn down by the City Council for OHS reasons. On the next day, Toni was informed about his successful bid which he immediately paid for by cheque.

2 days later, Toni turned 18. He found out that the house he bought no longer existed. He then goes to the City Council to lodge his complaint and upon discussions with the Town Mayor, he found out that there was another house available for the same price. However, it was on prime land with a high value and owned by the Mayor. The Mayor offered to exchange the property to Toni if Toni could make a small donation to their social club. The Mayor also offered to speak to the City Brokers to change the details of the property and assured Toni that an exchange could be done. Toni paid the donation of $20,000.00 to the Mayor.

7 days after meeting the Mayor, City Brokers contacted Toni and told him that the house is no longer available as it was burnt down, that they will retain the money for another property as per the terms of bidding offer. The Mayor did not arrange for his property exchange.

Advice Toni on the legal issues arising from these facts and the possible legal remedies open before them or against each other.
