This week we learned about "Surveys and Land Descriptions" and how the boundary lines are determined for real property by a surveyor, who locates all building, structures, and boundary lines for that property.These lines - called "metes & bounds" for the property help us determine the square footage or acreage for the property and form the LEGAL DESCRIPTION for that property - which is recorded on the TITLE DEED for that property.

Facts:Joe & Mary own Blackacre Farm.An old wooden fence forms the boundary line between Blackacre a neighboring property, called Greenacre, which is owned by Judas Jones.Over the years a long section of the fence has completely collapsed and Judas' cattle (cows) have crossed the fence to graze on 25 acres of Blackacre.This has gone on for some time and now Judas claims that he owns the land.

Discussion Question: Do you think Judas has a claim?How many years would his cows have to be grazing before his rights might become valid and under what theory?What should Joe & Mary do ndwhy is it important to know the "metes & bounds," of their property?Discuss the potential legal problems you think may arise between neighbors when they don't know exactly what they own?
