This week we learned about the elements of a claim of negligence (duty, breach, causation and damages) and the burden of proof a plaintiff must meet in order to succeed on such a claim. It is one thing to read about the elements of negligence in a textbook, but is entirely different to have to determine how your particular state defines the tort of negligence. As a paralegal, you may very well find yourself working on personal injury cases and will be compelled to have a good understanding of how your state defines negligence and the plaintiff's burden of proof. To help develop your knowledge in this regard, this week you will be examining and reporting on the law in your home state.

Using your Lexis Advance account, conduct research of the law in your home state in order to discover and determine how the courts of your state define negligence and what a plaintiff must prove in order to succeed on such a claim.

Once you have completed your research, compose an Initial Post in which you discuss how your state defines negligence and the burden of proof a plaintiff bears. Use proper legal citations pursuant toThe Bluebookfor at least one primary source of law to support your response
