He wears FPL's branded uniform for drivers, uses FPL's device for signing off deliveries and is required to follow FPL's procedure while carrying out deliveries. While driving one day, he was involved in a ghastly accident and sustained a severe spinal cord injury causing him to be wheelchair-bound and has resulted in a long absence from work. Unaware of Thomas's condition, FPL wrote to him indicating that his services are no longer required due to his long period of absence at work. Thomas wants advice on his employment status and if he will be entitled to a discrimination claim. Zainab is a full-time employee who has been working as a sales consultant for 6 months. She raised this with her line manager who told her that her salary had to stay that way due to budgetary constraints. James is a full-time employee working with FPL for 6 years. Due to a surplus staff compared to available work, he was informed without prior consultation that his services were no longer required but was offered the same position in a different branch at their Brussels office, retaining his present salary. He refuses the offer as he would have to move to a new country, secure a new house, and change to a smaller company car. Fariha is the only black member of staff of FPL and despite having the same qualifications as Philip has only worked with FPL for 9 years as an IT consultant, she was selected for promotion by FPL to the post of regional manager in line with FPL's diversity and inclusivity policy. Philip is extremely furious about her appointment and wants advice on the viability of a discrimination claim against FPL.
