Three friends, Amber, Barry, and Camille are having lunch. They are discussing life and realize that they each need to find a good attorney.
- Amber just had a child and is concerned about drafting a will that will provide for her spouse and her child in the event of her death. She is concerned about the costs and, of course, wants to find an attorney who is going to d o a good job.
- Barry, on the other hand, is not experiencing such happy life events. His business partnership seems to be failing. Although the business itself seems to be doing well, he and his partner simply cannot seem to agree on anything. Barry complains that maybe that is what happens when you marry your partner and the marriage sours along with the business. His divorce and the dissolution of the business partnership is likely to be long and contentious.
- Camille, sadly, has her own set of issues. About a month ago, she was the passenger in a terrible rollover accident. Her friend, who was driving, was not at fault, but did not have good insurance. Camille is considering trying to sue the negligent driver who caused the accident, but needs to find a good attorney. She does not have much money with all of the medical bills that have piled up and could certainly use some good advice.
In your essay, using the I-R-A-C format,
- Please list the three common types of fees charged by attorneys and provide a brief definition of each.
- Make a recommendation for each of these three friends and justify based on the facts of the case. Your justification needs to explain why one type of attorney fee structure would be best for each of these three friends.
Please be careful not to create facts that are not given in the scenario. You must select a type of fee structure for each person and that fee structure must be valid based upon your reading. There are some fee structures that just would not apply to specific scenarios and sometimes there are more than one possibility. You only have to select one option, even if there is more than one possibility.
