Tim is employed as an apprentice electrician by Wally's Wires Pty Ltd (Company). The Company has 20 employees and has contracts for electrical work with various large organisations. Tim is a first-year apprentice. He has been employed for 8 months to date. Tim is undertaking a rotation of the various types of work undertaken by the Company. He is presently with the tag and test team, who drive to a client's premises, and test that electrical items are operating correctly, and place a tag on them to identify they have been tested. Gordon is the team leader of the tag and test team. Gordon spends a considerable amount of time on social media, and is an aficionado of prankster videos, a genre of social media content in which social media "influencers" film pranks in pursuit of fame and wealth. Gordon decides Tim is the perfect target for Gordon's pranks. Over the course of a month, Gordon: 


a) Smears chilli on Tim's sandwiches. 


b) Deflates the tyres on Tim's ute.


c) Puts raw fish in Tim's water bottle. 


d) Puts itching power in Tim's work-clothes. 


In each instance, Gordon films Tim's reaction. Whilst the pranks are inane, the other team leaders laugh and enjoy them. Gordon always says, "don't worry, I won't post the videos online", but he shows the videos to other colleagues at work. One day, Tim is onsite at a client's premises, when Gordon decides to play another prank on Tim. When Tim is inside a roof cavity, Gordon removes the ladder and disappears around the corner. Tim is forced to call out for help, as he is stuck in the roof cavity, and an employee of the client comes to assist, locating a ladder from the client's workplace to help Tim down. Tim goes home that night and, in the shower, he starts to cry. "I can't take it anymore" he sobs. He calls in sick the next day. He locates the employment pack he was given at the commencement of employment, but he cannot locate a bullying policy. 


Advise Tim on whether he has grounds to make an application for a Stop Bullying Order from the Fair Work Commission under the Fair Work Act 2009 (Cth)? (Assume that the Company is a constitutionally covered business for the purpose of the Act). What are the possible outcomes of the process?
