Tim is going to town in his pickup truck with his two twin sons, Timmy, Jr. and Jimmy, both 13 years old. As they drive down Main St., Tim sees a mattress on the side of the road. Knowing that he needs a mattress for the house, he stops to check this one out to see if it still has some use. After examining the mattress, Tim decides to keep it. He tosses the mattress into the bed of the pickup truck. However, he has nothing to tie it down with. So Tim tells Timmy and Jimmy to sit on the mattress in the bed of the truck so that he can get it back home without it flying out of the truck. Timmy and Jimmy get on the mattress and Tim proceeds home.

Tim, now realizing he is late getting home, begins to speed down Main St. He is proceeding approximately 10 miles per hour over the posted speed limit. As he takes a left turn at this speed, Tim's son Jimmy falls out of the bed of the truck onto the pavement. As a result, Jimmy hits his head and dies.
