Tim was infatuated with Rose. He asked her out for a drink on several occasions but, Rose, who was in a relationship with John, refused. Tim made hundreds of silent phone calls to Rose's home, sent her letters, and turned up at her doorstep a few times. Rose developed a stress disorder as a result of Tim's behavior which required her to have medical treatment.

Fed up, Rose purchased an air rifle. One afternoon, she heard noises outside her door. Rose spotted Tim and so she rushed outside with the rifle and fired it randomly into the air to scare him away. A pellet struck Gina, a neighbor, causing a cut to her leg. The cut aggravated an injury Gina was suffering from, and she has now been left with a permanent limp.

At that moment, John returned home. He spotted Tim walking along the pavement. John grabbed hold of a brick and began chasing Tim who started to run away as fast as he could. Suddenly Tim fell over and landed heavily on his arm, breaking it.
