LEGAL PRINCIPLE (LP): Criminal statutes must be exact in their terms and precise in their means of enforcement. Then move onto the next issue you find and use the same format.

1) Ned is behind on his rent and his landlord threatens to kick him out if he doesn't pay by the end of the week, so Ned meets with his recently unemployed friend Mike and asks him to help him rob a bank . They agree to do the robbery but realize they need some guns, so they call their friend Tim who runs a gun shop and ask him if he can provide them with some guns but do not tell Tim what the guns will be used for. Tim meets them at the parking lot of the bank and offers them 3 guns for $150.00. Ned and Mike take two guns and pay Tim. After the transaction Tim decides to cash some checks and goes into the bank with the extra gun in his pocket. Ned and Mike then enter the bank and approach the bank teller with their guns drawn. Tim tells the bank guard that neither of the guns he sold them have any bullets, and only the gun he is carrying is loaded. The guard then holds Ned and Mike until the police come and arrest them. Ned tells the police everything that happened. The robbery statute in their jurisdiction reads as follows: "Whosoever, with the intent to steal, takes and carries away the moveable property of another, by the use or threat of force , shall be guilty of Robbery". The district attorney charges Tim under the following statute: "Any person who intentionally enters a place of business while knowingly possessing a loaded and operational firearm shall be guilty of attempted robbery". State each issue and its corresponding legal principle.

2) Mel goes golfing and after he finishes he puts his clubs on the rack in the parking lot and goes into the clubhouse for some drinks. By 10:00 p.m. and after drinking 6 martinis and a few shots of whiskey, he decides to go home. Mel goes out to the parking lot and grabs a bag of clubs off the rack and puts them in his trunk and drives home. Another golfer leaves the clubhouse to go home and realizes his golf clubs and bag are missing from the rack in the parking lot. He reports his clubs stolen to the course manager who reviews the parking lot security camera and sees that Mel took the clubs and put them in his trunk before leaving. Police trace the license plate to Mel and ask him to open his trunk. Mel says, "Sure, I didn't do anything wrong". Upon opening the trunk and seeing the golf clubs Mel says, "How did those get in there?, those aren't my clubs". Mel is charged under the following statute: "Whosoever, takes and carries away the moveable property of another without the owner's consent and deprives the owner of the property for more than 3 days shall be guilty of theft". At Mel's jury trial the judge instructs the jury as follows: "After hearing all the evidence of the case, if you find beyond a reasonable doubt, that Mel did take and carry away the moveable property of another without the owner's consent and deprived him of said property for more than 3 days, you may find him guilty of theft". State each issue and its corresponding legal principle.
