- Tony Stark, recently retired from saving the world, bought a nice little restaurant in his hometown of Malibu. Tony is particularly proud of the restaurant's dessert offerings - so much so that he decided he wanted to display his desserts prominently to customers. To doo this, he ordered several refrigerated units with glass to display desserts in his restaurant from Happy Hogan's Refrigerated Displays, Inc. Happy Hogan faxed a credit application to Stark. The application was faxed back with a signature that appeared to be Stark's. Hogan delivered the units. When they were not paid for, Hogan filed a suit against Stark to collect. In court, Stark denied that he had seen the application or signed it. He testified that he referred all credit questions to "the girl Pepper that works for me in the office." Hogan testifies that that he doesn't care who pays him or that Stark's signature may have been forged, just that he wants to get paid.
