Topic: State Jurisdiction Following a military coup in 2010, Istan has become a secretive state which systematically represses any opposition to its military leadership. In 2020, Istan issued a decree which made it a criminal offence, punishable by death, to protest against the government of Istan, including in any place outside Istan. Renee fled to Australia from Istan in 2018, was granted a permanent protection visa and renounced her citizenship of Istan. Renee has been organising weekly protests outside the Istan Embassy in Canberra. At one protest in 2022 Renee threw a can of red paint over one of the walls of the Istan Embassy. In January 2024, the Istan Prosecutor's Office (IPO) commenced proceedings against Renee in the Supreme Court of Istan. After a summary hearing, Renee was convicted and sentenced to death in absentia. The IPO also prosecuted several members of Renee's family in Istan for 'aiding an enemy of the Istan state.' Renee's father was detained and repeatedly tortured at the direction of Istan's Chief Prosecutor, who has overseen a large-scale program targeting opponents of the Istan government and their family members. This has involved the use of arbitrary imprisonment, enforced disappearance, torture and extra-judicial killings. In February 2024 the Chief Prosecutor travelled to Tunisia in a private capacity and he was detained at Tunis-Carthage Airport. The Tunisian authorities are considering what action, if any, they are required to take under international law. You are a legal officer in Australia's Department of Foreign Affairs and Trade and have been asked to consider the international legal issues relevant to any representations the Australian Government may make to the Tunisian Government in relation to Istan's Chief Prosecutor.
