HOW TO ANSWER LAW PROBLEM QUESTIONS?

The Four-Step IRAC Method: Issue - Rules - Application - Conclusion.

1. Identify the Issue: Read through the facts. Ignore facts which are irrelevant i.e. facts which do not raise any legal issue.

Pay special attention to facts which are relevant i.e. facts which do raise legal issues.

2. Rules (the Law): Identify the legal issues raised in the facts. Identify the relevant laws, which deal with those issues. Explain and elaborate the laws. Do not relate to the facts of the question yet.

3. Application: Apply the relevant law to the legal issues raised in the question. Analyse and discuss how the law will deal with the facts of the question. A good answer would analyse at depth and not at surface level.

4. Conclusion: Finally submit what is the probable outcome as a result of applying the law to the facts of the question. Begin your answer by saying "The facts of the question raises the following issues..." End the answer by saying "Party A is advised that she does/does not have a cause of action or may/may not succeed in her claim/action."
