Harry is president of the Canberra Sports Club. The team have won the ACT championships and will compete at the national competition in Brisbane in December 2020. Harry books the flights and accommodation with TravelCo for himself and his team. The advertised accommodation in the package has a pool, a stocked bar fridge and is next door to the competition green. (Before he signed the contract, Harry told Shelly that he chose this hotel because he wanted a short trip to the competition each day).

When the team arrive in Brisbane, Harry is told that the selected hotel has been closed due to flooding and that the team will be accommodated at another hotel 2 hours from the competition green. Harry and the team are unhappy because even though the hotel has larger private rooms and a pool, it is too far away and doesn't have a bar fridge. When Harry rings to complain, Apple refers to Clause 13 of the contract and takes no action. Clause 13 in the formal contract between the Harry and TravelCo states:

"If the accommodation advertised is unavailable, TravelCo may substitute alternative accommodation of equivalent standard."

Harry and the team are weary from travelling between the hotel and the green and believe that this is why they didn't win the national competition.
