TUTO SALE OF GOOD (BUSINESS LAW)

Question 3 Samad is the owner of Syarikat Teraju Jaya, a firm selling new and used electrical appliances. On 3rd May 2020 Mrs Wong went to Syarikat Teraju Jaya and bought from Badar, an employee there, a new oven and a second-hand commercial cake mixer for use in her catering business. As she was in urgent need to use the commercial cake -mixer, Mrs Wong took delivery of that very day. She arranges with Badar for her employee, Jalil, to pick up the oven on 10 May when he would bable to borrow a van for that purpose from his friend. However on 7th May, Kasim, from whom Badar hoped to obtain a big contract, telephoned to ask Badar if he had the same model of oven in stock for immediate collection. When Badar replied that the only one he had already been sold, Kasim persuaded Badar to sell the oven to him and he collected it that very same day. On 10th May, when Jalil went to Syarikat Teraju Jaya to collect the oven, he was told that it had been sold to Kasim. Later, the police came to Mrs Wong's shop and took possession of the commercial cake mixer. Apparently, the commercial cake-mixer had been stolen from Yusof's shop. It had been sold by the thief to Badar, who was unaware of the theft. Mrs Wong had used the commercial cake mixer since 3 rd May 2020. With reference to relevant authorities, advise Mrs Wong as to her rights with regard to the oven and the commercial cake mixer. 50 marks
