Pat was selling her taxi cab business. In January 2019 she was approached by Frank and during negotiations Pat made the following statements:
- The income last year was 30,000; and she gave Frank the accounts to inspect. However, Frank did not have the time to go through the paperwork for the entire year.
- The profits should increase as a result of two new nightclubs due to be opened in the city.
- In her opinion, the business should expand as a result of a new hospital wing which will open in April of the same year.
Frank bought the business in March 2016. He discovered that the income was only 15,000. In addition, he found out that the two nightclubs were refused a licence by the council and so they will no longer open. This was published in the local newspaper in February 2016. To make matters worse, when the hospital wing opened, a rival taxi business was given a contract to advertise in the hospital and so Frank's Taxi business has not benefitted at all. A former friend of Pat suggests Pat knew about this back in December 2015.
When Frank discovered that there was no extra business from the hospital and that the income was only 15,000 he decided to decorate the business premises and create a cosy waiting area. Unfortunately, by May 2016, the business was not any better and so Frank wants to take legal action.
Advise Frank as to the remedies available to him.
