Grovesfield Developments Ltd, a subsidiary of Grovesfield Holdings plc, owns the freehold title to a plot of land in the centre of Fullerton, a town in Somerset. The land is undeveloped and Grovesfield obtains planning permission to construct a four-storey office block on the land. Grovesfield duly commences construction of the office block immediately after planning permission has been granted.

Northanger Developments Ltd owns the freehold title to two plots of land adjacent to the plot under Grovesfield's ownership and control.

During the course of the construction of the office block on Grovesfield's land, Careful Construction Ltd, a local firm engaged by Grovesfield to construct the office block, place tower cranes on Grovesfield's land for the purposes of carrying out the construction. The booms of these cranes oversail Northanger's land at various times during the course of the construction.

Northanger is your client and the company's directors seek your advice. In particular, they want to know if they will be able to obtain an injunction preventing any further invasion of what they feel is their airspace.
