Zali offered to sell his new hand phone to Azlan at the price of RM5,000. Azlan responded by stating that the price was too much and that he was prepared to take it for RM4,000. Zali disagreed and the following day sold the hand phone to Leha at the price of RM5,000. Azlan later decided to accept the price of RM5,000, and went to see Zali. However Zali told him that the hand phone had been sold to Leha. Azlan wished to sue Zali on the ground that there was an existing contract between them.
