Under state tort law, criminal justice agencies may be found liable when their conduct or the conduct of their employees constitutes negligence. Identify some of the types of negligent torts (i.e. both intentional and unintentional torts) that Ross described and indicated are the most frequently encountered by criminal justice agencies. In discussing these torts, briefly discuss the significant features (e.g. what needs to be proven or shown) or issues encountered in proving each.
