Use the following fact pattern for Questions 2 & 3 below - Clyde Barrow was speeding to the bank to rob it. He then robbed it, and drove away very fast from the bank in his fast car. He sped through the bank parking lot to get out of there. In doing so he backed into Bertha, a 70-year-old woman on her way into the bank. Clyde had been looking at the bank to see if he was being followed and didn't see her. Bertha died on the spot.
Surprised he had killed the woman, Clyde slowed down and began to obey traffic and road rules and made his way back to his hide-out. Just before turning slowly into the driveway of his hide-out, 4-year-old Peggy-Sue suddenly ran out into the driveway and Clyde struck her down with his car, killing her. He had applied the brakes but couldn't stop in time. He didn't see her because she was short and ran fast. A hardened robber, neither death bothered him.
