Using a videotaped testimony is something that should never be done, for numerous reasons. The role of a witness in a crime is when this person has either witnessed or has heard the crime take place. Witnesses have a lot of information about the crime and this could persuade the outcome of the trial because of this particular information that they do possess. The first reason that a videotaped testimony should never be done is that a video can be constructed or blocked in order to persuade or rock the trial in one way or another. The second, is when the testimony is on video you are unable to truly read the witnesses body language, eye contact, emotions, facial expressions and their overall energy surrounding the crime and its occurrence. In an instance where the witness has been videotaped it would not be fair to make a decision, considering you don't have the whole scope of the crime. It is hard to get the right evidence and information needed off of a video, which could also drag that trial towards the wrong directions and this could be potentially very detrimental to a party that does not deserve it.

Allowing victim statements during sentencing is an ethical practice in the criminal justice system because it recognizes the rights and experiences of the victims. It emphasizes the ethical significance of providing victims with a voice and an opportunity to communicate the effects of the crime on their life. By this approach, victims are given an opportunity to express their points of view, their feelings, and the effects that the offense against them has caused. Through involvement with the judicial process, victims can feel heard leading to a sense of healing and empowerment. Victim statements can give courts important information that helps them decide on the right sentencing and gives them a more complete picture of the harm that was done. However, the possibility of bias or emotional impact on sentencing choices must also be taken into account when discussing ethics. There should be measures in place to guarantee that victim statements help in sentencing without affecting the concepts of justice and due process for all parties.
