1. Melissa is an accountant. Recently she went to a convention she attended annually. She needed to attend to keep up with her professional accreditation and her government department employer paid for her registration and accommodation without question. Her accommodation included a bar tab. On the final night, after the closing address, she retired to the bar to have a drink with another accountant she knew. After some more drinking, they decided to take a walk across town and see the sights at night. As they were returning to the hotel where the conference was being held, a masked man accosted them and pushed Melissa onto the road when she resisted him stealing her handbag. She was slow to get up and a truck driving past could not avoid her. She was seriously injured. She will not be able to return to work for an extended period.

Advise Melissa if

(a) She can make a legislation-based claim for compensation for her injury. (5 marks)

(b) On report of her injury to a relevant government agency, her employer could be in breach of safety legislation. (5 marks)
