USING IRAC Professor Farrell posted the following on his Contracts' course TWEN site: I intend to sell
Question:
USING IRAC
Professor Farrell posted the following on his Contracts' course TWEN site:
I intend to sell my beloved Black's Law Dictionary
With all my personal notes in it.$50 OBO.
Mr. Notso Intel Igente responded immediately by email, saying "I accept. I'll pick up the book tomorrow after class." One hour after that, Ms. Gennie Us also answered, saying "would you take $40"? To which Professor Farrell responded "Yes, if you raise it to $45."Ms. US then answered "sold!"When Mr. Igente came to pick up the book, he was shocked and angered to find that Ms. Us had 'bought it out from under him,' and wants to know if he can sue Professor Farrell for breach of contract.
Answer Mr. Ignete's question by addressing each manifestation in turn.
[NOTE:In order to determine whether Mr. Igente can sue for breach of contract, we must determine whether a contract exists, such that it might be breached.]
