The Macquarie Fencing Club $($MFC$)$ is an unincorporated association set up to allow its members to participate and compete in the Tasmanian Fencing Club competition. The club holds fencing training and events at the Macquarie Sports Centre, a community$-$based sports facility run by the Macquarie Heads Council in Tasmania. As part of upgrading due to expansion, the committee of the Club $($made up of $8$ members$)$ decides to purchase new fencing equipment for the benefit of its members $(30$ members$).$ Sally, who is the President of the club, signs a contract in the club$$s name with FencingGear Pty Ltd to provide the club with new fencing equipment. On the first night of practise for $2024,$ Rain $($a member of MFC$)$ is severely injured when the sword $($p$$e$)$ pierces her protective headgear due to a defective design of the mesh. Rain is initially hospitalised and is not able to return to work for a month. It is later discovered that Sally was aware that the equipment was cheap and potentially dangerous, but she wanted to save money for the club so she went ahead.
