Varun, residing in Mumbai, offered to sell Waman a second hand reaping machine. Varun said that the machine was in another town, Ahmedabad, and that it had been newly bought the previous year itself. Varun also mentioned that it had been used to cut fifty or sixty acres only. The machine at that time did not belong to Varun. He purchased it from the owner and sent it through railway to Waman. Waman received the machine, and within two days wrote a letter to Varun stating that the machine sent to him, appears to be too old and that it has been repaired. It seems that it has been used for more than sixty acres. As such it is of no use. Waman further moved the court for recovery of the price. Discuss.
