Waivers are an important part of the sport and fitness industry. However, waivers arent always as protecting to an organization as one might think. Read the section within Chapter 5 of the text about waivers, paying special attention to how the courts look at waivers. Then, read the Moot Court Case at the end of Chapter 5 in your book. When you are finished reading, answer the following questions: Waivers must be signed, and Taylor signed the waiver given to her by the recreation department. Does this alone mean that the court should absolve the school of liability? Taylor and her teammates did not read the waiver. Does this mean a court should not hold them to what they signed? Remember, this isn't about your own opinion on the situation, but rather your opinion on how the courts might look at both sides of the argument.
