We studied the case of J. Reynolds Tobacco Co., et al. v. FDA, et al., No. 11-5332 (D.C. Cir. 2012). The case addressed the issue of freedom of speech and whether tobacco companies could be required to add graphic pictures on their packaging so that consumers would be on notice as to the potentially damaging effects of smoking. Recently, there has been a renewed effort to have that packaging revised to include graphic imaging.
