Wedding #1:On 11/1xxafter negotiation and discussions of details in Ms. Holland's office at the hotel, Xavier enters into a written "estimate" with Continental Hotels, Inc. for her wedding reception to be held in a certain ballroom with a certain meal, etc. the reception to be held on 6/5/xx and the cost to be $75/guest, minimum of 100 guests maximum of 125, the final number to be reported on 6/1/xx, a partial payment of $3,000 made at the time of signing this document. The estimate has many details not relevant to this problem, it is getting complicated enough. The "estimate" is signed by Ms. Holland, as the catering manager and supervisor for this particular hotel. The estimate says nothing about a possibility that the costs in the estimate may rise.

On 6/1 Xavier calls Ms. Holland up and reports 110 guests will be coming and also finalizes a few other details such as delivery of the cake and flowers and items to be served at the bar. Ms. Holland says that the price has gone up to $95/guest because of increased expenses and if Xavier does not sign a revised estimate for that amount, then the reception has to be canceled. Xavier argues but signs the revised estimate because it is only a few days to the wedding and she can do nothing about finding a new place.
