A cheek sample for DNA was obtained. The profile did not match the assault case but did match an unsolved rape case from 2003. He was convicted of the rape and sentenced to prison. His attorney argued on appeal that this was an invasion of his privacy and the DNA results were inadmissible. The prosecutors argued that a cheek swab was no more invasive than a fingerprint. The Maryland Court of Appeals reversed the conviction and sent it back to a lower court. As a result, 16,000 DNA profiles collected postarrest but preconviction could not be used pending the final appeal.
