Second, assuming the Satava is copyrightable, is the Lowry an unauthorized derivative work and, if so, does it have any copyrightable elements of its own? Answer: The Satava is a work that is copyrightable because it is original, shows authorship and is fixed in a tangible medium of expression. The Lowry on the other hand is an unauthorized derivative work because the copyright owner has the exclusive rights to make any derivatives of the original. The Lowry does have some elements that are copyrightable. It is original to its creator and is fixed. It is not an exact replica of the Satava, so it could be said that it was inspired by the Satava. Originality doesn't have to be unique
