What are your thoughts on the answers to questions below? The New Jersey Supreme Court in State v. Henderson took extraordinary steps to conform the state's judicial evaluation of eye witness identification reliability with lessons learned from three decades of exoneration data and scientific research. To date, only one other state supreme court (Oregon) has taken similar measures. We have also seen numerous law enforcement jurisdictions adopt best practices to mitigate against identification contamination by state actors.Do you think the NJ and OR judiciaries overstepped their bounds in their unilateral adoption of advanced reliability criteria? Do you think reform efforts should be left to law enforcement agencies alone for implementation? Is a combined effort the best approach? Are any reforms really necessary? Answer: I do not think either judiciary overstepped its boundaries in the adoption of advanced reliability criteria. If anything I think more judiciaries should adopt the advanced reliability criteria to minimize mistaken identities and punishing an innocent person. The purpose of them stepping in was to find a solution to prevent what has been going on for 3 decades and that is punishing innocent people for crimes they did not commit. The system is failing and to correct its changes must be made and I feel that is what NJ and OR have done. No, I do not think reform efforts should be left to law enforcement to implement. I believe not enough accountability would be held if law enforcement agencies were the only ones implementing reform. Without oversight or combined efforts, I feel the reform efforts would be very one-sided. By working together it will help plan and implement reforms for the criminal justice system as a whole, in hopes of reducing the misidentification and overwhelming the courts and prisons. The combined effort would be the best approach as both law enforcement and the judicial system play a role in each other. Reforms are necessary to improve and correct the system for the better and can benefit all components within the community
