What is the distinguishing characteristic between what is required to be disclosed to the other party under rule 26 of FRCP, and what can be considered "attorney work product" and can therefore be protected? It seems there is a fine-line between Rule 26 which requires parties to make initial disclosures of persons/materials they may use as support at trial, and "work product" which is material prepared by attorney in preparation for litigation.
