Hypothetical: Officer Frank is the School Resource Officer at West High in West World Florida. It's Officer Frank's first day on the job. At the beginning of the school day Officer Frank hears what sounds like gun shots coming from the track. Seconds later he gets a call from on his radio that there are gun shots being fired from the Science building. Officer Frank goes to the building. He hears more shots. He decides it's to dangerous to go into the building and instead sets a parameter around the building. He calls for backup and keeps students away from the building. When the back ups arrive the building is secured. When police enter the building they see 2 students have been shot and killed. The shooter is arrested. It turns out to be a disgruntled and bullied student who was suspended a day earlier. The student came back to seek vengeance on those who bullied him. The parents of the dead students sue Officer Frank and his department in Federal Court. They allege Officer Frank had a duty to "protect and serve" the students in the school? Who will ultimately win this law suit based on the current law.
