Defendant Flowers was charged with the Murder of 4 former coworkers at a furniture store. 3 of the victims were American adults, the other an African-American teenager aged 16.

The State decided to try Flowers for the Murder of Bertha Tardy (the owner of the store). According to the record, the Prosecution, during this trial made several references to the fate of the other victims of this crime. This action violates Rules of Court, as he was not being tried for the deaths of the other victims, only the Store Owner.

In addition to this, the jury selected was an all-white panel. A review of the history of the State's peremptory strikes in Flowers' first four trials strongly supported the conclusion that the State's use of peremptory strikes in Flowers' trials were motivated in large part by discriminatory intent. Over the course of Flowers' first trial, all 36 non-black Jurors were removed. An investigation concluded that the State's relentless, determined effort to rid the jury of black individuals strongly suggests that the State wanted to try Flowers before a jury with as few black jurors as possible, and ideally before an all-white jury.

The strange part here, is the State used the Same prosecutor in ALL 6 trials against Flowers. In each case, Flowers was convicted and sentenced to life or death in Prison. An appeal of the decisions was successful. All 6 of Flowers' convictions were overturned for a reason of Prosecutorial Misconduct.
