When 49-year-old Norma Corrigan joined Planet Fitness, a franchise gym, she received three one-hour sessions with a personal trainer, Liam. During the first session, the trainer placed her on a treadmill set at 3.5 mph for 20 minutes, and left her unattended. She was not instructed on how to reduce the speed or stop the treadmill. Soon she tired, drifted back on the treadmill, tried to walk faster and, failing, was thrown from the treadmill and broke her ankle. Before hiring him, Liam's boss Maria, the gym manager, did check to make sure his certifications were up to date and called his references. The gym does have a supervisory policy that mandates the number of employees watching the gym floor at all times and inspected the equipment to ensure it was working properly. Norma wants to sue everyone! She can try to hold Maria liable using an ordinary negligence standard.
