When ABC LLC held a party where alcohol was suffered at the party, Dan drank too much and clearly was not able to drive. Tim, Dan's manager suggested that Dan shouldn't be driving under alcohol. Dan refused and Tim let Dan drives home under the consumption of alcohol. Later Dan got into a car accident and hit a pedestrian. Is the pedestrian allowed to sue ABC LLC or Tim (the manager) under the Social Hosting Liability?
