Where there has been a fundamental breach, the non-breaching party can under art 49 avoid the contract. This is done by notice, as per art 26. The buyer must elect to avoid within a reasonable time (art 49). According to art 25, a breach is fundamental if it substantially deprives the other party of what they contracted for.
