While studying towards a Bachelor of Accountancy, Alex had a regular summer job working as a clerk at the local branch of SpreadSheet, the largest accounting firm in the region. Last summer Alex was offered a fulltime permanent position as a junior accountant, upon completion of her degree, by Charlie, the branch manager. Alex gladly accepted as she wanted to work in her hometown.

Alex finished her degree in semester two and confirmed her start date with Charlie via email. At the end of Alex's first day, Charlie gave her "some paperwork from HR" to read "when you have time".

The first document reads:

Dear Alex,

OFFER OF EMPLOYMENT - JUNIOR ACCOUNTANT

We are pleased to offer you employment as a junior accountant at SpreadSheet. The attached draft individual employment agreement contains the proposed terms and conditions of your employment.

Your starting salary will be $33,280.00 per annum plus 8% holiday pay (being equivalent to 40 hours per week at the starting out wage).

This is an entry level position which is subject to a 90-day trial period. A key requirement is flexibility of hours and location. By taking this position you agree to work in our different branches as required and to work whatever hours are required to keep our clients happy.

The letter goes on to state that if there is anything in the offer of employment that she is unclear about, or disagrees with, then she should contact her branch manager, Charlie, at first instance.

Alex has questions about the content of the letter so the next day she approaches Charlie's office. When she is just outside the door she overhears Charlie talking on the telephone saying: "She's a good little worker but she won't be with us long. She'll leave to start a family like they all do, so we might as well work her hard while she's with us." Alex hurries back to her desk and decides to get some employment advice.
