Wong entered into an agreement to sell a consignment of 8OO kilograms of sugar in Penang Melaka, for RM 60,000. Not agreed to pay the purchase price upon the delivery of the sugar to his shop in Melaka. Wong instructed Kai to deliver the sugar to Nat and to collect the payment from Nat. Kai drove the lorry carrying the sugar consignment and upon arrival in Melaka, Kai was informed that Nat was insolvent and is unable to pay for the delivery of the sugar. Kai notified Wong.
