Woolworths was a supermarket located within the Westeld Shopping Centre at Mt Druitt. On 10 November 2010, Tracey Ryder suffered serious spinal injuries when she slipped on a patch of soapy liquid on the oor of the common area of the Centre, just outside the premises occupied by Woolworths. The point at which the respondent fell was close to the checkout counters of the supermarket. CCTV footage was available of the incident and of events in the area leading up to Ryder's fall. No doubt by reason of the footage, it is not in dispute that the soapy liquid found its way onto the common area as the result of the actions of a little girl, about ve years of age. She is shown on the CCTV footage walking or skipping from the supermarket checkout area into the passageway between the supermarket and other areas occupied 2 by retailers. The CCTV footage also shows the little girl at or near the checkout area in the company of a man and woman who are the girl's parents. When the little girl was in the passageway she can be seen blowing bubbles from a rod of some kind with a ring on the end of it. The little girl then glanced at the oor and rubbed the area with her feet. Shortly afterwards, Ms Ryder was walking along the passageway parallel with the boundary between the supermarket and the cormnon area, slipped at the spot where the little girl has been blowing bubbles. Ryder had not been a customer of Woolworths immediately prior to the fall, but gave evidence that she was going into the supermarket. It is also shown in the CCTV footage that the bottle of bubble mixture was purchased from Woolworths and Tom, an employee of Woolworths, opened the bottle from which the child subsequently blew bubbles, and from which the substance (over which Ms Ryder fell) eventually spilled. Robert was standing near Ryder at time of the accident. He quickly jmnped to the scene to help her. In an attempt to lift Ryder up, Robert broke her left arm severely. As a result of the accidents, Ryder was hospitalized for two months. The medical bills for the spinal injuries and the broken arm were about $40000 and $15000 respectively. After the spinal injuries, Ryder was no longer able to work as a dancing teacher which used to give an income of $10000 per month. ***
