Each student will write a brief case synopsis of ONE Canadian criminal or civil case within this century (2021). There is no fixed format for a case brief but it should contain only the essential elements of the case. These include the following: 1. Case identification: name of the case (parties involved), date and court (citation). 2. Introduction: if an appeal, (a) the decision of the court(s) and (b) the points appealed. 3. Statement of facts: the events that gave rise to the legal problem(s). Give sufficient information regarding the events so they are clearly understandable to your peers. 4. Legal issues: the legal problems, which the court must resolve in the case. 5. The judgment (or decision): the outcome of the case. 6. Reasons for the judgment: In summarizing the reasons for judgment (i.e., why the court arrived at the decision it did), you should attempt to state the legal principle upon which the disposition (decision) of the case turns. This is known as the "ratio decidendi" of the case (see handout given to you). Other legal principles stated in the reasons but not instrumental in the disposition of the case are called "obiter dicta" 7.
