NO 2 B : Rill6 Message from: David Campbell Message to: Trainee Law Hi Trainee, I would like to meet with you later this week to discuss a case that has been referred to us by Lawton police force. The brief information I have received from the officer dealing with the case is as follows: Sam Maxwell attended all the Lawton Rugby Football Club matches to watch his boyfriend, Felix Rodriguez, play rugby. Sam regularly shouted from the side-lines during the matches, causing Felix to be embarrassed. Sam also video recorded all Felix's games so that he could play the tapes back to Felix after the match and point out his mistakes. Sam has recently placed Felix on a strict diet to manage his weight and has told him that he shouldn't see any friends, except people that they both know through the rugby club. As a result of Sam's behaviour, Felix has become very isolated, has lost a significant amount of weight, and appears to be suffering from depression. During last week's rugby match, Sam became enraged at the referee, Morag Kelly, when he didn't agree with one of her decisions. When Morag approached Sam to try and calm the situation, Sam honestly but mistakenly thought that Morag was about to assault him by pushing him away from the side-lines. Sam rugby tackled Morag to the ground to ward off her 'attack' and as a result, Morag suffered a broken wrist. We will need to consider the criminal liability of Sam Maxwell under s76 Serious Crime Act 2015 in respect of his behaviour towards Felix and s47 Offences Against the Person Act 1861 in respect of his behaviour towards Morag, including whether he can rely on the defence of self-defence.
