Xavier owned a bookstore and coffee shop. Xavier entered into a contract with Yankee Printing where Yankee Printing agreed to make 50 pieces of custom fabric wall art for Xavier. Yankee Printing would order special fabric and then print several book and coffee designs on the fabric and then mount the fabric on decorative boards. Yankee bought all of the materials and delivered 30 pieces of art to Xavier when they were completed. When Yankee Printing dropped the completed art off, Xavier said he did not realize how big the art would be and that he could not use any more. Xavier paid for the 30 pieces but said he would not accept or pay for the other 20. Yankee printed and mounted the remaining twenty pieces and sued Xavier when Xavier refused to accept delivery or pay for the remaining 20 pieces.
