Ye-Jun finds a modified and restored, seemingly perfect condition 1990 Honda CRX for private sale from a vendor in Edmonton. She gets a friend of hers to drive her up to Edmonton, and prior to purchasing the vehicle for $20,000, she asks the vendor if the car is in good working order, or if there is anything wrong with the car that they know of. The vendor, Sam, assures Ye-Jun that the car is in perfect condition, and that he knows of nothing that is wrong with it. Ye-Jun agrees to buy the car for $20,000, and drives the car away that day. After 10 minutes of driving, she realizes that the car is driving really rough, and the ride is bumpier than she anticipated. She pulls over to the nearest Honda dealership, and gets the car in an hour later. She is told by the mechanic that there is a major issue with the suspension, and that it will cost approximately $3000.00 to repair. Further, the mechanic tells her that Sam had just had the car in a month ago, and he knew of the issue, and chose not to get it fixed. Prior to agreeing to have it repaired, and as she is sitting in the waiting room, researches the state of the law on her phone. She realizes that she could get the contract rescinded for misrepresentation. She loves the car, and the mechanic tells her that otherwise it's in great condition, so she decides to get it repaired. About a year later, she wants to upgrade her car to something newer, and so at that point tries to rescind the contract for misrepresentation. Can she do so?
