You are a paralegal in a busy United States attorney's office. The job is very exciting, and you are always learning about new areas of the law. You have been tasked with researching several issues connected to the following case:
A very wealthy and prominent businessman has been charged with trafficking several underage girls and women. He trafficked them for both labor and sex. As he owns several properties throughout the United States, he is facing federal charges. His assistant, Maximillian Smith, is also being charged with several crimes. Although he did not engage in the acts with the victims, Maximillian made the initial contacts and arrangements with the victims. The office has offered Maximillian a plea deal in exchange for his testimony against his former employer. As part of the plea deal, he is to provide the names and contact information for the victims - many of whom live outside of the United States. In order to receive the full cooperation of Smith, he wants to be assured the victims will be safe. He already admitted to his role in a television interview, but he will not testify at trial without these assurances. You have been tasked with researching what measures the office can use to protect the international victims and if Smith's admission in the interview can be used at the trial.
Maximillian Smith's attorney has filed a motion to prevent your office from admitting his television interview into evidence at trial. Your supervising attorney has asked you to research whether or not the statements he made in the television interview are admissible. Prepare the first draft of an internal legal memorandum outlining your research and conclusion.
Directions:
The Maximillian Smith case appears to be going to trial. Draft a letter template that you can send to the potential victims and witnesses, updating them as to the status of the case thus far. The letter should be one page. It will include a greeting, an introduction of you (the paralegal) working on the case, and a brief summary as to what has happened. It will then have a conclusion and proper closing.
Tips:
- 1.This will be going to multiple individuals on letterhead. Therefore, there is no need to put in any names at this time. But, you should use proper spacing to insert the names later.
- It is important to note that you are a paralegal.
- Be sensitive to the fact the recipients are crime victims.
