You are an Associate to a Judge in the Equity Division of the NSW Supreme Court. The judge has just heard a matter whereby the plaintiff is claiming that property ('Greenacre'), a farm registered in the name of the plaintiff's father, was held on trust by the plaintiff's father either for him (the plaintiff) or for himself and his brothers in equal shares. The plaintiff's father died in 2020 and in his will, he left all his property to his new wife.

The following was tendered in evidence:

1.An affidavit sworn by the plaintiff's mother (the plaintiff's father's first wife) that she was present when her then husband said to his sons 'the farm is yours now'.

2.A handwritten note, signed by the plaintiff's father stating that 'I hope you're happy with the arrangements for the farm. I think its better for you boys it's handled this way'.

3.An affidavit sworn by the family solicitor, stating they recall drawing up trust deeds in relation to Greenacre, but are not in possession of them and can't find any record of them.

With reference to the above information, give a statement informing the Judge what legal issue is to be decided.
