You are hosting a dinner party tonight (here in Houston Texas.) The party is to celebrate a big deal you are set to close on today at work. Unfortunately, you realize that there are still a lot of details to iron out before the deal can go through and you will not be able to make it home to cook the elaborate meal you had planned on and get it done before your guests arrive. You decide to order take-out from a favorite restaurant (a partnership), but you are concerned that you wont even have time to pick up the food and still be home to receive the guests at the appointed hour. You have already paid for the food and you know that the route your friend Ana will take to get to your house will take her right by the restaurant, so you ask her to swing by and pick up the food for you on her way. Amy agrees to pick up the food and does so but upon her exit from the restaurant parking lot, she is involved in an accident with another driver resulting in property damage and personal injury to both drivers. Ana knows that she carelessly did not look in both directions before entering the roadway and feels that this caused or contributed to the accident. The other driver knows that he was texting when the accident occurred and feels that this caused or contributed to the accident. The police take a long time to arrive and Ana gets hungry and easts some of the food that she was bringing to the party for you. Four hours later, Ana becomes violently ill. The hospital confirms food poisoning. The only food she ate within the window given to her by the doctors for the cause of her illness, was the food from the restaurant. Discuss the contractual issues presented (who has a contract with whom? Was there a breach? If so, what damages can be expected?) for 5 points; whether any agency relationships exist )and what that does or does not mean between and among the parties)-for 5 points; and what tort(s) occurred (along with the expected outcome(s))-for 5 points
